gamimap provides a white-label gamification platform for tourism regions, enabling location-based challenges, blockchain rewards, and AI-powered visitor management. Our Services include:

Website access and information about our platform
Contact forms and demo requests
Platform software and services (for clients)
Content management systems and mobile applications
Analytics and reporting tools

3. User Accounts and Registration

To access certain features of our Services, you may need to create an account. You agree to:

Maintain the security of your password and account
Accept responsibility for all activities under your account

6. Client Services and White-Label Solutions

6.1 Service Agreement

Clients purchasing our white-label platform solutions will enter into a separate Service Agreement that outlines specific terms, pricing, deliverables, and support.

6.2 White-Label License

Our white-label solutions grant clients a limited, non-exclusive, non-transferable license to use our platform under their own branding, subject to the terms of the Service Agreement.

6.3 Data Ownership

Clients retain ownership of their user data collected through the platform. gamimap retains ownership of the platform software and technology.

7. Payments and Billing

For paid services:

All fees are as quoted in your Service Agreement
Payments are due according to the agreed payment schedule
Late payments may result in service suspension
Refunds are subject to the terms of your Service Agreement
All prices are exclusive of taxes unless otherwise stated

8. Privacy and Data Protection

Your use of our Services is also governed by our Privacy Policy. We are committed to protecting your personal data in compliance with GDPR and applicable data protection laws.

9. Third-Party Services

Our Services may integrate with third-party services (e.g., blockchain networks, payment processors, analytics tools). We are not responsible for the availability, accuracy, or content of third-party services.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

The Services will be uninterrupted, timely, secure, or error-free
The results obtained from using the Services will be accurate or reliable
Any errors in the Services will be corrected

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAMIMAP SHALL NOT BE LIABLE FOR:

Indirect, incidental, special, or consequential damages
Loss of profits, revenue, data, or business opportunities
Damages arising from use or inability to use the Services
Damages exceeding the amount paid by you for the Services in the past 12 months

You agree to indemnify and hold harmless gamimap and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from:

Your use of the Services
Your violation of these Terms
Your violation of any rights of another party

13. Termination

We reserve the right to suspend or terminate your access to the Services at any time for:

Non-payment of fees (for paid services)
Fraudulent or illegal activity

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Berlin, Germany, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts in Berlin, Germany.

These Terms of Service, together with our Privacy Policy and any Service Agreements, constitute the entire agreement between you and gamimap regarding the use of our Services.
